SINGAPORE GRAND PRIX PHOTOGRAPHY COMPETITION
TERMS & CONDITIONS
1. In submitting an entry to the Singapore Grand Prix Photography Competition (the “Contest”), jointly organised by the Singapore Tourism Board and Singapore Grand Prix (the “Organiser”), you are deemed to accept these terms and conditions (this “Agreement”).
2. The Contest is open to all individuals, regardless of age, nationality and country of residence. However, employees of the Singapore Tourism Board (“STB”) and the Organiser's representative offices, Singapore Grand Prix (“SGP”), authorised agencies, principal sponsors associated with this Contest, Contractors and immediate family members of all such employees are not eligible to enter the Contest. Corporate or other entities are also not eligible to participate in this Contest.
3. All entries must be submitted through the website www.visitsingapore.com/mysgp (“Website”) and comply with the specifications for submissions approved by the Organiser. All photographs must be in digital form, in JPEG (.jpg) format only and must be no larger than 5 megabytes (MB) and dimensions of 800 x 600 pixels (W x H). The Organiser reserves the right to disqualify entries that do not comply with these specifications.
4. Winners must be able to provide a copy of their winning photo(s) in high resolution, 300 dpi, A3 format, upon request by the Organiser.
5. If you are under twenty-one (21) years of age at the time of submitting your entry, your parents or legal guardians must jointly and severally consent to your participation in the Contest. Such consent must be in the form and upon terms prescribed by the Organiser. Without such consent, your entry will be disqualified.
6. The Contest commences now and closes on Friday 20th March 2009, 2359 hours. The Organiser accepts no responsibility for late, lost, garbled or misdirected entries.
7. Each entry shall contain up to three photographs. Multiple entries per participant are permitted.
8. All details and particulars submitted must be true, accurate and complete. Any incorrect or incomplete information submitted will result in the disqualification of the entry. By submitting your details and particulars, you consent to the Organiser using such information, including the public disclosure of the same, and contacting you for the Organiser's marketing efforts. You agree to participate in, at your own expense, prize presentation ceremonies and all other publicity events in Singapore in relation to the Contest, without payment or compensation. You further consent to the public disclosure of any statement, comment or quotation that you may give, and the reproduction, adaptation and translation into any language and publication of the same by the Organiser.
9. The Organiser will shortlist Contest entries at its sole discretion and publish the shortlisted photographs on the Website.
10. The winners of the Contest will be selected by a panel of judges appointed by the Organiser. The decision of the judges appointed by the Organiser shall be final and no correspondence with participants will be entertained.
11. The decisions of the Organiser on all matters relating to the Contest, including but not limited to the eligibility of participants, conduct of the Contest, shortlisting of the photographs, the winners of the Contest, and the determination or replacement or substitution of any winners or prizes, shall be final and no correspondence with participants will be entertained.
12. The winners of the Contest will be announced 15 April 2009. Each winner will be notified by email or phone in accordance with the contact details provided with their entries. If a winner does not acknowledge receipt of such notice or collect the prize within the time limit prescribed by the Organiser, the Organiser shall be entitled to treat the prize as forfeited and to select another winner. Winners will be notified of the prize collection details and shall collect and utilize the prizes in the manner instructed at their own cost and expense. Non-Singapore residents may be required to collect their prizes in Singapore. The winners' names will also be published on the Website.
13. Prizes are not transferable, exchangeable or redeemable for cash, credit or other benefit in-kind. Prizes are also subject to the validity periods and any other terms and conditions as may be imposed by the prize sponsors. All prizes are not inclusive of any taxes and other expenses / costs, all of which are the sole responsibility of the winners.
14. Notwithstanding anything in this Agreement, the Organiser reserves the right at any time in its absolute discretion to: (a) cancel or modify the Contest; (b) determine and/or amend, by addition to, deletion from or variation of, these terms and conditions without prior notification, including but not limited to, the eligibility terms and criteria, the selection of winners, and the timing and venue of any act to be done, and all participants and winners shall be bound by such determination and/or amendments; and/or (c) substitute, withdraw or cancel any prize without prior notice and without having to disclose any reason therefore and without any payment or compensation whatsoever.
15. All entries submitted for the Contest, including all photographs and images submitted, will be the sole property of the Organiser and will not be returned.
16. The entire right, title and interest (including intellectual property rights) in and to your entry (whether or not prize winning) and all materials submitted with your entry, and in and to all works based upon, derived from, or incorporating your entry or any part thereof shall vest exclusively in SGP, its successors and assigns. You shall do all things and sign and execute all documents as SGP may reasonably require to perfect, protect or enforce any intellectual property rights assigned to SGP under this Agreement. SGP shall be entitled, without further reference to you, to exercise all intellectual property rights in your entry, including the use, adaptation, modification, reproduction, translation, exhibition, publication, display and archival of your entry or any part thereof in any context and with or without other material, in any medium now known or hereafter devised, whether or not for profit, for the full period of protection arising pursuant to the laws in force in any part of the world including all renewals reversions and extensions and to authorise others to do the same. In no event shall the Organiser be required to use any entry, whether in whole or in part.
17. You warrant to the Organiser that (a) your entry is an original work and you have the necessary right, power and authority to assign to the Organiser all rights, title and interest in and to the entry as required in this Agreement; (b) the Organiser's use of the entry in accordance with this Agreement will not infringe or violate any intellectual property rights or other rights of a third party; (c) you waive and have obtained waivers from any contributors to your entry of all moral rights or rights to be named as author(s) in relation to the entry or any part thereof; and (d) nothing in the entry is libellous, slanderous, defamatory, scandalous, threatening, obscene, pornographic, offensive, lewd, improper or of such a nature which contravenes any laws, or may subject The Organiser to any action, proceedings or demands from any persons, and is not likely to damage or bring into disrepute the name or reputation of the Organiser.
18. If required by the Organiser, you shall at no expense to the Organiser provide a high quality copy of the photograph submitted with your entry or render such reasonable assistance as the Organiser may require to use or implement your entry for the purposes contemplated in this Agreement.
19. STB, STB's representative offices, SGP, authorized agencies, contractors and sponsors, and the directors, officers, employees and assignees thereof shall not be liable for (a) any claim, damage, loss, injury or inconvenience arising out or in connection with the Contest or any prize, including the award thereof to or use thereof by any person; (b) any event of force majeure, including without limitation any calamity or conditions, acts of God, war or warlike hostilities, civil commotion, riots, blockades, embargoes, sabotages, strikes, fires, lockouts, shortages of material or labour, terrorist activity, epidemic, quarantine restrictions, health risk or any other occurrence beyond the reasonable control of the Organiser nor any of the Organiser's representative offices, authorized agencies and sponsors; (c) any entries or other communications that have been lost, late, illegible, incomplete, tampered with, corrupted, mutilated, misdirected or undelivered for any reason; or (d) any defect, failure, interruption, breakdown, malfunction, delay or unavailability of any postal services, machine, computer system, hardware, software, data processing system, email account, communications network or transmission link or other cause that in any way prevents or limits any person's ability to submit a valid entry to the Contest or receive communications or that causes any damage to any person's computer systems.
20. You hereby release STB, the STB's representative offices, SGP, authorized agencies and sponsors, and the directors, officers, employees and assignees thereof, completely from any and all claims, demands, causes of action, expenses, damages, attorneys' fees, obligations and suits, of any kind, in law, equity or otherwise, whether known or unknown, disclosed and undisclosed, now or hereafter arising out of or in connection with the Contest, any prizes, your breach of any term or warranty of this Agreement and/or your acts or omissions in relation thereto. You further agree to indemnify and hold harmless STB, the STB's representative offices, SGP, authorized agencies and sponsors, and the directors, officers, employees and assignees thereof, from and against any and all such claims, demands, causes of action, expenses, damages, attorneys' fees, obligations and suits.
21. This Agreement is governed by and construed in accordance with the laws of the Republic of Singapore, and you submit to the non-exclusive jurisdiction of the courts of Singapore in the determination of any matter or dispute arising in connection therewith.
22. This Agreement is not intended to confer rights on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act (Cap 53B) or otherwise, and no third party shall have any right to enforce any provision of this Agreement.
